No late fee at all or you must change it to a later date to accommodate the later payment date?
No late fees before they receive their disability check. If they get paid on the 10th, you need to accommodate the 10th as the due date. You could not charge a late fee until the 11th
No you dont have to.
Under the landlord-tenant act you don't BUT if you don't have a policy of when a tenant qualifies for lease renewal, you are treating them differently and that puts you in fair housing jeopardy
Do we have to redo the current disclosures we currently have filled out for properties or is this just for new listings/rentals.

I’m in a similar situation. Yesterday I walked in to get the keys to the new apartment. I made all the fees and firsts months rent payment in April. I knew they were doing a bunch of renovations but would be done by may 10th which is when I got the keys, the very nice old maintenance man walked me through to write down things that needed to be fixed or done. He left bad it wasn’t fully ready. Bath tub was in terrible condition as well as dishwasher and fridge. They weren’t cleaned. The patio door was broken where I couldn’t go out on to the patio properly. I also noticed in every window sill there appeared to be mold or even black mold. We aren’t fully moving in till the 14th but it was supposed to be all done by the 10th now I’ve seen possible mold as well. My 3 year old son has serious health issues. 2 months ago he had his 4th open heart surgery so mold is not acceptable. I reached out to the property manager and her response was I’ll talk to you Monday. How is this all going to be done in one day before we move? We won’t have anywhere else to stay. I’ve paid 2,000 some dollars before move in day expecting it to be done. I’m a very easy going person but this isn’t okay. We don’t have the money to find a different place. Any advice?

Great info! I know you said to get an attorney to draft a Tenant Selection Policy, but would love to see an example of one, or list of things that should be included in one to see and/or compare ours.
You're assuming the policy you're comparing against has legal screening criteria. That's been the fatal flaw of most tenant selection policies. We copy from someone else to save legal fees. I get what you're saying but be careful when looking at anothers... ;o)

This seems so petty. Why would anyone deny an applicant because they are on disability as long as there is enough money to pay the rent. I can't believe someone would file a complaint because a landlord requires employment.
I believe most wouldn't HOWEVER by saying you must have employment in your tenant selection plan, you're telling a Fair Housing investigator that unless you don't accept disability as income.

I am in the "first camp", not to give a reason. Here in Ohio we are not required to state a reason. So it can be a good reason or a silly reason. As long as it isn't contrary to discrimination laws, it's legal.
It is quickly becoming a Fair Housing issue to not have a tenant eligibility policy for lease renewal

It's in committee now and whether or not it makes to the general file is unknown. If it does pass, it would take affect 90 days from the governor's signature.

A Lancaster County judge threw out my 7 day notice because I emailed it to my tenant even though it was in the lease as the preferred method of delivery. They showed up and one of the legal nonprofits represented them. Bunch of crap. I really hope this passes

Do you know of any kind of organized letter writing campaign to our respective state senators to express concerns with LB1115, LB187, LB845, LB545 etc.?
@@paulvfortier The landlord groups have been active in encouraging their members to write their state senators. Not much other than that
I am not sure why anyone would want to even be a landlord anymore with all these ridiculous statutes they have already passed and trying to get passed. In the end it will actually hurt who they are supposedly trying to protect because landlords will start selling in droves I believe. Maybe these Senators are in the pockets of these large hedge funds who are the only people who can afford to pay for all these proposed bills. IMO.

Yep that is what I have seen in a lot of court cases on youtube involving tenants is that they apply for short term voucher programs and then when they can't get it again they stop paying rent and then it takes the landlord 6 to 9 months to go thru multiple court sessions where the tenant says they are waiting for approval(and maybe they are) as they short term or reoccurring voucher systems are over loaded and very tentative. THen they take an entitled stance saying they have no place for them and their kids to go and the judge gives them months more to move.
